Terms of Service

These terms are an agreement between you and Wise Guy Games LLC, doing business as Truck Pass. By using Truck Pass you agree to them.

What Truck Pass is

Truck Pass connects customers with independent food trucks. Each truck makes and sells its own food and is responsible for it, including quality, allergens and food safety. Truck Pass takes and processes the order and payment.

Customers

• Prices, menus and hours are set by each truck and can change.
• Your card is held when you order and charged when the truck accepts. If the truck declines, the hold is released.
• For problems with an order, contact the truck first. Trucks can refund from their app, and we can help if needed.
• Tips go to the truck in full.

Food trucks

• The Truck Pass fee is 5% of the food subtotal of each order placed through Truck Pass. It isn't charged on tax or tips. There's no monthly or setup fee.
• Card processing is charged by Stripe at its standard rate and comes out of your Stripe balance. Stripe's fee isn't returned on refunds; the Truck Pass fee is refunded in proportion.
• You must have a Stripe account in good standing, follow Stripe's terms, and hold the licenses and permits your locations require.
• Truck Pass collects and pays sales tax in the states where the law requires it. You're responsible for any local meals tax and for the rates you set in the app.
• You're responsible for your menu, prices, photos and staff accounts, and for the food you serve.

Referral earnings are described in the app's referral terms, which are part of these terms.

Your account

Keep your sign-in secure and give accurate information. We may suspend accounts that break these terms, misuse the service, or put customers or trucks at risk.

Liability

Truck Pass is provided as is. To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability to you is limited to the fees you paid us in the 12 months before the claim.

Changes and law

We may update these terms and will tell you in the app when a change is important. These terms are governed by the laws of the Commonwealth of Virginia.
